If a lawsuit or court proceeding is permitted under these Terms, you and Kovacs Systems agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Denver, Colorado, USA for the purpose of litigating any dispute, to the fullest extent permissible pursuant to applicable law.
No Class Actions
TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, YOU AND Kovacs Systems AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Kovacs Systems agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding, to the fullest extent permissible pursuant to applicable law.
Copyright and Ownership
Kovacs Systems or its suppliers own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or dissemble any aspect of the Service which Kovacs Systems or its suppliers own.
